Discuss Your PERM Application with a Leading U.S. Labor Certification Lawyer

U.S. labor certification attorney Marcine A. Seid assists employees in the labor certification process to sponsor foreign workers for permanent residency (green cards). The labor certification process is known as Program Electronic Review Management System (PERM).

Labor Certification: Reduction in Recruitment, Traditional, and PERM

Labor certification applications filed before March 28, 2005, were filed under one of two programs:

  • The Reduction-in-Recruitment (RIR) program
  • The traditional labor certification procedures

The RIR and traditional labor certification programs were replaced by the PERM Process. Most pending labor certification applications have been transferred to the U.S. Department of Labor (USDOL) Backlog Elimination Center (BEC), where they will be adjudicated. While RIR and traditional labor certifications can no longer be filed, our labor certification attorney can still help you if you have an existing application that is currently being adjudicated at one of the at one of the USDOL Backlog Elimination Centers. We can also help you re-file your labor certification application under the PERM process.

PERM has reduced the amount of time required to process recruitment and labor certification applications. Employers can now obtain a labor certification for foreign workers in less than six months, rather than the more than two years under RIR or the traditional labor certification process.

If you have an existing RIR application that is being adjudicated as a part of the USDOC backlog, it may be beneficial to refile your labor certification application under the new PERM process. However, the new PERM certification requirements are more restrictive than the RIR and traditional requirements, so not all applications will qualify under PERM. If you are interested in processing a new PERM application for a green card or permanent residency, or discussing if re-filing an existing labor certification application would be beneficial, please call an experienced labor certification lawyer at 408-271-9888 or fill out our contact intake form. We can assist you no matter where you are located.
